Ruptured aorta leads to medical malpractice lawsuit

Doctors in Arizona and other states are required to meet acceptable standards of care. If loved ones are lost due to medical malpractice or errors made by doctors, the surviving family members may pursue financial relief. This is precisely what the children of a deceased mother in a neighboring state did.

The children allege medical negligence on the part of a physician, a radiologist and an emergency room doctor along with two medical facilities. According to court documents, sudden, severe pain in her upper back sent the 59-year-old woman to the hospital early in Dec. 2016. Because he suspected a torn aorta, the presiding physician ordered a scan. The complaint states that the radiologist failed to administer the correct test, and although an aortic dissection was evident -- as the doctor suspected -- the radiologist dismissed the signs as a shadow, and the doctor sent the patient home.

Seven days later, the woman went to a different medical facility of the same group, complaining of chronic pain in her upper back. However, the emergency room doctor accessed her medical records, and based on the test result from the previous week, he sent the patient home. Early in the evening of the following day, the woman died when her aorta ruptured.

Her children assert that she would not have died then had the problem been diagnosed and accurately treated. The family demands a jury trial for the lawsuit in which they seek recovery of financial and emotional damages along with legal costs. Arizona families who have to deal with such traumatic losses may share their suspicions with an attorney who is experienced in dealing with medical malpractice claims. If the lawyer finds grounds for a medical malpractice lawsuit, he or she will provide the necessary support and guidance throughout the ensuing legal proceedings.
