Plaintiff obtains substantial award in medical malpractice case

A woman acting as administratrix for the estate of a deceased nursing home patient walked away from recent litigation with a victory. The jury ordered $13 million paid to the decedent's estate in the medical malpractice case. An attorney for the plaintiff said it would not be surprising if an appeal were to be filed as that is quite common following such verdicts. Problems reportedly began when an elderly man with special medical care needs entered a nursing home in another state. The patient has undergone a below-the-knee amputation and was in need of round-the-clock care. Those acting on his behalf in court say not only was appropriate care not provided but the utter neglect shown was the direct cause of a serious health decline.

The man's death occurred in another facility and was said to be unrelated to the medical malpractice claim. However, the claim states that the nursing home where the man had resided was at one time listed as one of the worst nursing homes in the nation. Administrators were accused of putting money ahead of patient needs. 

Other families apparently filed many complaints against the nursing home as well. As for the now-deceased patient, he reportedly suffered several terrible falls and fractures due to lack of appropriate attention and care.
